Agreement
These Terms of Service ("Terms") govern your use of ax4e.com, our related sites, free tools, and paid services operated by Access for Everyone ("AX4E," "we," "us"). By using our sites or services, you agree to these Terms.
Services and plans
AX4E provides web accessibility software and services, including an assistive widget, automated scanning and AI-assisted remediation, PDF and document remediation, expert audits, documentation, and training. Plan features and pricing are described on our pricing page. Monthly plans renew month to month and may be canceled at any time, effective at the end of the current billing period. Annual plans prepay twelve months at the discounted rate. Enterprise engagements are governed by their own written agreements, which control if they conflict with these Terms.
Your responsibilities
- You must have the right to install our widget and run scans on the websites you submit.
- You are responsible for reviewing and deploying suggested code fixes; you control your own website.
- You agree not to misuse the services, including attempting to disrupt them or use them to violate any law.
Important disclaimer - no guarantee of compliance, no legal advice
No tool, widget, or service - ours included - can guarantee legal compliance or immunity from lawsuits. A widget alone does not make a website compliant. Our software and services help you identify, fix, and document accessibility issues against WCAG standards, and we are honest about what automation can and cannot do. Conformance ultimately depends on your implementation and ongoing maintenance of your own digital properties.
Nothing on our sites, in our reports, or in our communications constitutes legal advice. Content about the ADA, Section 508, and related laws is provided for general information. For legal advice about your obligations or exposure, consult a qualified attorney.
Intellectual property
The AX4E sites, software, content, and marks are owned by Access for Everyone or its licensors. We grant you a limited, non-exclusive license to use the services as intended. You retain all rights to your own websites and content; you grant us only the access needed to provide the services you request.
Limitation of liability
To the maximum extent permitted by law, AX4E's total liability arising out of the services is limited to the amounts you paid us in the twelve months preceding the claim, and we are not liable for indirect, incidental, or consequential damages, including legal claims brought against you by third parties relating to the accessibility of your properties.
Termination
You may stop using the services at any time. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive (including the disclaimer, intellectual property, and limitation of liability) survive termination.
Governing law and changes
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. We may update these Terms from time to time; material changes will be reflected by the date at the top. Continued use after changes constitutes acceptance.
